大学等を新規に設置すること、又は既に設置されている大学等において学部、研究科等を新規に設置することに関する規制制度。1956年以降、この設置のためには、文部科学大臣の認可を必要としている。認可にあたり、文部科学大臣は大学設置・学校法人審議会に諮問することを必要としている。認可のための基準として、大学設置基準、大学院設置基準等の設置基準を文部科学省令で定めている。
2003年からは、当該大学等が授与する学位の種類及び分野の変更を伴わないものについては設置をあらかじめ届け出ることのみを要することとされている。また、設置認可については、有効期限に関する条件は付されていない。
なお、設置認可・届出後に、文部科学大臣は是正措置として関係法令に違反している大学等に対し、①改善勧告、②変更命令、③学部等の組織の廃止命令等の措置を段階的に講じることができる。また、設置認可・届出後から原則として完成年度までの学部等については、設置計画履行状況等調査（アフターケア）により、必要に応じて設置計画の確実な履行を担保するための指導・助言を行っている。

A regulatory system relating to the establishment of new universities and colleges or the establishment of new faculties or graduate school within an existing university or college. Since 1956, the approval of the Minister has been required for the establishment of such institutions. Before deciding on approval, the Minister is required to consult the Council for University Chartering and School Corporation. The Standards for Establishment of Universities, Standards for the Establishment of Graduate Schools and other MEXT orders stipulating standards for establishment serve as the criteria for approval.
Since 2003, it has only been necessary to provide notification if the establishment does not entail a change to the academic degree types and fields awarded by the university or college in question. No conditions are imposed regarding the validity period of approval.
The Minister may take phased corrective measures consisting of (1) a recommendation for improvement; (2) an order for alterations; and (3) an order for the abolition of the faculty or other organization against universities or colleges in violation of laws and regulations. Guidance and advice are provided to assure the implementation of the plan if need be through follow up on the implementation of university establishment plan (aftercare) until the first students graduate.
